6     Section 3.  Section 943.0311, Florida Statutes, is amended
7to read:
8     943.0311  Chief of Domestic Security Initiatives; duties of
9the department with respect to domestic security.--
10     (1)  The executive director of the department, or a member
11of the department designated by the executive director, shall
12serve as the Chief of Domestic Security Initiatives. The Chief
13of Domestic Security Initiatives shall:
14     (a)  Coordinate the efforts of the department in the
15ongoing assessment of this state's vulnerability to, and ability
16to detect, prevent, prepare for, and respond to, and recover
17from acts of terrorism within or affecting this state.
18     (b)  Prepare recommendations for the Governor, the
19President of the Senate, and the Speaker of the House of
20Representatives, which are based upon ongoing assessments to
21limit the vulnerability of the state to terrorism.
22     (c)  Coordinate the collection of proposals to limit the
23vulnerability of the state to terrorism.
24     (d)  Use regional task forces to support the duties of the
25department set forth in this section.
26     (e)  Use public or private resources to perform the duties
27assigned to the department under this section.
28     (2)  The chief shall conduct or cause to be conducted by
29the personnel and with the resources of the state agency, state
30university, or community college that owns or leases a building,
31facility, or structure, security assessments of buildings,
32facilities, and structures owned or leased by state agencies,
33state universities, and community colleges using methods and
34instruments made available by the department. Each entity making
35such an assessment shall prioritize its security needs based on
36the findings of its assessment. Each state agency, state
37university, and community college shall cooperate with the
38department and provide the assistance of employees within
39existing resources to provide to the chief information in the
40format requested by the chief. The chief must report to the
41Governor, the President of the Senate, and the Speaker of the
42House of Representatives if any state agency, state university,
43or community college substantially fails to cooperate with the
44chief in making a security assessment of the buildings,
45facilities, and structures of the state agency, state
46university, or community college.
47     (a)  The initial assessment of each building, facility, or
48structure owned or leased by a state agency, state university,
49or community college shall be completed by the state agency,
50state university, or community college and shall be provided to
51the chief no later than November 1, 2004.
52     (b)  Assessments of any building, facility, or structure
53owned or leased by a state agency, state university, or
54community college not previously provided to the chief under
55paragraph (a) must be completed by the state agency, state
56university, or community college and provided to the chief
57before occupying or substantially modifying such building,
58facility, or structure. The chief may request additional
59followup assessments to ensure that the security assessments of
60buildings, facilities, and structures, owned or leased by state
61agencies, state universities, and community colleges, remain
62reasonably current and valid.
63     (3)  The chief shall report to the Governor, the President
64of the Senate, and the Speaker of the House of Representatives
65by November 1 of each year prioritized suggestions for specific
66and significant security enhancements enhancement of any
67building, facility, or structure owned or leased by a state
68agency, state university, or community college or any entity
69that has conducted an assessment under subsection (5). The chief
70may utilize the assessments provided under subsection (5) in
71making his or her suggestions. The report shall suggest
72strategies to maximize federal funds in support of building or
73facility security if such funds are available must identify and
74prioritize the recommended security enhancements and provide
75recommendations to maximize federal funding in support of
76building and facility security.
77     (4)  To promote the continued safety of government
78buildings, facilities, and structures within the state, the
79chief shall work in conjunction with state agencies, state
80universities, community colleges, and local governments to
81recommend report to the Governor, the President of the Senate,
82and the Speaker of the House of Representatives recommended and
83implement best practices for safety and security of buildings,
84facilities, and structures owned or leased by state agencies,
85state universities, community colleges, and local governments.
86The chief may enlist the assistance of the State Fire Marshal
87and other domestic security partners in developing the
88recommended best practices. To promote the continued safety of
89government buildings, facilities, and structures within the
90state, the Best practices may be revised or enhanced by the
91chief as necessary. The recommended best practices are not a
92rule as defined in chapter 120.
93     (5)  The chief shall communicate to local governments and
94water management districts the importance of conducting security
95assessments of buildings, facilities, and structures owned or
96leased by such local governments or water management districts,
97and the options local governments and water management districts
98should consider in obtaining security assessments. The cost of
99any security assessment of a building, facility, or structure
100owned or leased by a local government or water management
101district shall be borne by the local government or water
102management district, as applicable.
103     (6)  The chief may communicate to private entities the
104options private entities should consider in obtaining security
105assessments and may solicit private entities for the purpose of
106communicating such options. The cost of any security assessment
107of a private entity shall be borne by the private entity.
108Private entities are urged to cooperate with and assist the
109department in meeting its responsibilities for domestic
110security.
111     (7)  As used in this section, the term "state agency"
112includes the Agency for Health Care Administration, the Agency
113for Workforce Innovation, the Department of Agriculture and
114Consumer Services, the Department of Business and Professional
115Regulation, the Department of Children and Family Services, the
116Department of Citrus, the Department of Community Affairs, the
117Department of Corrections, the Department of Education, the
118Department of Elderly Affairs, the Department of Environmental
119Protection, the Department of Financial Services, the Department
120of Health, the Department of Highway Safety and Motor Vehicles,
121the Department of Juvenile Justice, the Department of Law
122Enforcement, the Department of Legal Affairs, the Department of
123Management Services, the Department of Military Affairs, the
124Department of Revenue, the Department of State, the Department
125of the Lottery, the Department of Transportation, the Department
126of Veterans' Affairs, the Fish and Wildlife Conservation
127Commission, the Parole Commission, the State Board of
128Administration, and the Executive Office of the Governor.
