12assistance from the Office of Tourism, Trade, and Economic
13Development; providing for compensation of consultants;
14providing duties of the commission; requiring the
15commission to identify, examine, and review certain
16information related to aerospace and the aerospace
17industry; authorizing the commission to appoint technical
18advisory committees; authorizing reimbursement of travel
19expenses; requiring a certain number of meetings in
20various regions of the state; directing certain agencies
21and requesting other agencies to render assistance and
22cooperation; requiring preliminary and final reports;
23requiring the Office of Tourism, Trade, and Economic
24Development to prepare legislative recommendations
25consistent with the reports; abolishing the commission;
26providing an expiration date; providing that funding shall
27be contingent upon legislative appropriation; providing an
28effective date.

30     WHEREAS, the aerospace industry comprises an important
31segment of Florida's present and future economy, and
32     WHEREAS, intense nationwide and international competition
33for the future development of this industry is already underway,
34and
35     WHEREAS, the diversification of Florida's commercial,
36civil, and military aerospace industry and the strengthening of
37Florida's space-related research and development initiatives,
38including initiatives related to commercial, civil, and military
39space, are critical components of the future of Florida's
40aerospace industry, and
41     WHEREAS, Florida must ensure that the state is optimally
42positioned for NASA's new Vision for Space Exploration, and
43     WHEREAS, effective action and the necessary coordination of
44Florida's space-related resources must be based on a reliable
45assessment of the present climate for the aerospace industry in
46the state, and
47     WHEREAS, the Legislature finds there is a need to
48comprehensively consider the various options available for
49legislative action related to the multibillion-dollar aerospace
50industry in this state, NOW, THEREFORE,
51
52Be It Enacted by the Legislature of the State of Florida:
53
54     Section 1.  Commission on the Future of Space in Florida.--
55     (1)  The Commission on the Future of Space in Florida is
56created. The commission shall be composed of 13 voting members,
577 of whom are appointed by the Governor, 3 of whom are appointed
58by the President of the Senate, and 3 of whom are appointed by
59the Speaker of the House of Representatives. In consultation
60with the Florida Congressional Delegation, the Governor shall
61appoint two members of the delegation or their designees to
62serve as ex officio, nonvoting members of the commission. In
63addition, the Lieutenant Governor, Secretary of Transportation,
64executive director of the Florida Space Authority, and director
65of the Agency for Workforce Innovation or their designees shall
66serve as ex officio, nonvoting members of the commission. The
67Governor's appointments must include at least one appointment
68from seven of the following groups:
69     (a)  Aerospace manufacturing.
70     (b)  Aerospace operations and maintenance.
71     (c)  Aerospace finance.
72     (d)  Aerospace research.
73     (e)  Aerospace defense.
74     (f)  Commercial aerospace services.
75     (g)  An aerospace business with fewer than 250 employees.
76     (h)  Enterprise Florida, Inc.

78The President of the Senate and the Speaker of the House of
79Representatives shall each select one appointee from three of
80the groups listed in paragraphs (a)-(h) and, in addition, shall
81each appoint one member from their respective chambers of the
82Legislature to serve as ex officio, nonvoting members.
83Appointments under this subsection shall be made before July 31,
842005, and the first meeting shall be held no later than
85September 1, 2005. The chair of the commission shall be elected
86from among the voting members by majority vote of the membership
87at its first meeting. Meetings shall be held upon the call of
88the chair but not less frequently than monthly. Any vacancy
89occurring in the membership of the commission shall be filled in
90the same manner as the original appointment.
91     (2)  Each voting member of the commission is entitled to
92one vote, and action of the commission requires a majority vote
93of the voting members present. Action may not be taken if less
94than a majority of all voting members is present.
95     (3)  The commission may appoint an executive director who
96shall report to the commission and serve at its pleasure. The
97Office of Tourism, Trade, and Economic Development shall provide
98the commission and the executive director with staff assistance.
99The Office of Tourism, Trade, and Economic Development may, upon
100the request of the commission, pay compensation to consultants
101if such costs can be funded from the appropriation provided for
102in this act.
103     (4)  The commission shall:
104     (a)  Identify the current and future opportunities in
105aerospace operations, aerospace transport, aerospace education,
106aerospace tourism, and other aerospace areas and make
107recommendations for how the state can capitalize on such
108opportunities.
109     (b)  Review current federal, state, and local laws,
110ordinances, and rules that affect the aerospace industry in the
111state and recommend actions that will promote growth and
112diversification of the industry.
113     (c)  Examine the state's space-related policies and
114programs and recommend needed changes, including the possible
115restructuring of state space-related entities.
116     (d)  Examine the ways in which aerospace industries,
117including the component elements of manufacturing, assembly,
118marketing, servicing, maintenance, logistical support, human
119resources, and related research and development, can be
120attracted to locate permanently or expand in the state and
121recommend actions that can be taken by the state and local
122governments to accomplish this goal, including, but not limited
123to, possible financing alternatives.
124     (e)  Review existing studies to evaluate aerospace in the
125state, identify underserved resources, and recommend actions
126that can be taken to improve the competitiveness, availability,
127efficiency, and economy of the aerospace industry of the state.
128     (f)  Identify federal aid available to improve the state's
129aerospace infrastructure and services and recommend strategies
130to obtain such aid.
131     (g)  Determine whether the state's secondary and
132postsecondary schools are producing graduates who meet the
133workforce needs of the state's aerospace industry and recommend
134strategies to improve meeting those needs.
135     (5)  The commission may appoint technical advisory
136committees. Commission members and the members of any technical
137advisory committees may not receive remuneration for their
138services, but members other than public officers and employees
139are entitled to be reimbursed by the Office of Tourism, Trade,
140and Economic Development for travel and per diem expenses in
141accordance with s. 112.061, Florida Statutes. Public officers
142and employees shall be reimbursed for travel and per diem
143expenses by their respective agencies in accordance with s.
144112.061, Florida Statutes.
145     (6)  The commission must hold at least five public hearings
146in different regions of the state to solicit input from the
147public on the future of space in the state.
148     (7)  All agencies under the control of the Governor are
149directed and all other agencies are requested to render
150assistance and cooperation to the commission.
151     (8)  The commission shall prepare a preliminary report of
152its findings and recommendations by January 16, 2006, and a
153final report with specific recommendations by January 30, 2006.
154The Office of Tourism, Trade, and Economic Development shall
155prepare legislative recommendations consistent with the
156commission's reports for consideration by the Legislature at the
1572006 Regular Session. Copies of the reports shall be submitted
158to the Governor, the President of the Senate, and the Speaker of
159the House of Representatives.
160     (9)  The commission is abolished, and this section expires,
161on May 31, 2006.
162     Section 2.  Funding for the implementation of this act
163shall be contingent upon legislative appropriation.
164     Section 3.  This act shall take effect July 1, 2005.
