4 | Remove everything after the resolving clause and insert: |
5 | That the amendment to Section 5 of Article XI and the |
6 | creation of Section 26 of Article XII of the State Constitution |
7 | is agreed to and shall be submitted to the electors of this |
8 | state for approval or rejection at the next general election or |
9 | at an earlier special election specifically authorized by law |
10 | for that purpose: |
11 | ARTICLE XI |
12 | AMENDMENTS |
13 | SECTION 5. Amendment or revision election.-- |
14 | (a) A proposed amendment to or revision of this |
15 | constitution, or any part of it, shall be submitted to the |
16 | electors at the next general election held more than ninety days |
17 | after the joint resolution or report of revision commission, |
18 | constitutional convention or taxation and budget reform |
19 | commission proposing it is filed with the custodian of state |
20 | records, unless, pursuant to law enacted by the affirmative vote |
21 | of three-fourths of the membership of each house of the |
22 | legislature and limited to a single amendment or revision, it is |
23 | submitted at an earlier special election held more than ninety |
24 | days after such filing. |
25 | (b) A proposed amendment or revision of this constitution, |
26 | or any part of it, by initiative shall be submitted to the |
27 | electors at the general election provided the initiative |
28 | petition is filed with the custodian of state records no later |
29 | than February 1 of the year in which the general election is |
30 | held. |
31 | (c) The legislature shall provide by general law, prior to |
32 | the holding of an election pursuant to this section, for the |
33 | provision of a statement to the public regarding the probable |
34 | financial impact of any amendment proposed by initiative |
35 | pursuant to section 3. |
36 | (d) Once in the tenth week, and once in the sixth week |
37 | immediately preceding the week in which the election is held, |
38 | the proposed amendment or revision, with notice of the date of |
39 | election at which it will be submitted to the electors, shall be |
40 | published in one newspaper of general circulation in each county |
41 | in which a newspaper is published. |
42 | (e) Unless otherwise specifically provided for elsewhere |
43 | in this constitution, if the proposed amendment or revision is |
44 | approved by vote of at least sixty percent of the electors |
45 | voting on the measure, it shall be effective as an amendment to |
46 | or revision of the constitution of the state on the first |
47 | Tuesday after the first Monday in January following the |
48 | election, or on such other date as may be specified in the |
49 | amendment or revision. |

51 | SCHEDULE |
52 | SECTION 26. Approval of constitutional amendments and |
53 | revisions.--The amendment to Section 5 of Article XI, requiring |
54 | a vote of at least sixty percent of the electors voting on the |
55 | measure for the approval of a proposed amendment to or revision |
56 | of this constitution, shall take effect upon approval by the |
57 | electors. |
58 | BE IT FURTHER RESOLVED that the title and substance of the |
59 | amendment proposed herein shall appear on the ballot as follows: |
60 | REQUIRING BROADER PUBLIC SUPPORT FOR |
61 | CONSTITUTIONAL AMENDMENTS OR REVISIONS |
62 | Proposes an amendment to Section 5 of Article XI and the |
63 | creation of Section 26 of Article XII of the State Constitution |
64 | to require that any proposed amendment to or revision of the |
65 | State Constitution, whether proposed by the Legislature, by |
66 | initiative, or by any other method, must be approved by at least |
67 | 60 percent of the voters of the state voting on the measure, |
68 | rather than by a simple majority, and to provide that the |
69 | amendment to Section 5 of Article XI shall effect upon approval |
70 | by the electors. The amendment to Section 5 of Article XI would |
71 | not change the current requirement that a proposed |
72 | constitutional amendment imposing a new state tax or fee be |
73 | approved by at least 2/3 of the voters of the state voting in |
74 | the election in which such an amendment is considered. |
