11 | Be It Resolved by the Legislature of the State of Florida: |
12 |
|
13 | That the amendment to Section 3 of Article XI of the State |
14 | Constitution set forth below is agreed to and shall be submitted |
15 | to the electors of Florida for approval or rejection at the |
16 | general election to be held in November 2006: |

19 | SECTION 3. Initiative.-- |
20 | (a) The power to propose the revision or amendment of any |
21 | portion or portions of this constitution by initiative is |
22 | reserved to the people, provided that, any such revision or |
23 | amendment, except for those limiting the power of government to |
24 | raise revenue, shall embrace but one subject and matter directly |
25 | connected therewith. Any amendment or revision proposed by |
26 | initiative shall: |
27 | (1) Amend or repeal an existing section of this |
28 | constitution on the same subject and matter; |
29 | (2) Address a right of a citizen of this state as |
30 | established in Article I of this constitution; or |
31 | (3) Change the basic structure of state government as |
32 | established in Article II, Article III, Article IV, or Article V |
33 | of this constitution, except that no amendment or revision shall |
34 | deprive the branches of government of any existing powers |
35 | granted in these articles. |
36 | (b) The initiative power It may be invoked by filing with |
37 | the custodian of state records a petition containing a copy of |
38 | the proposed revision or amendment, signed by a number of |
39 | electors in each of one half of the congressional districts of |
40 | the state, and of the state as a whole, equal to eight percent |
41 | of the votes cast in each of such districts respectively and in |
42 | the state as a whole in the last preceding election in which |
43 | presidential electors were chosen. |
44 | BE IT FURTHER RESOLVED that the title and substance of the |
45 | amendment proposed herein shall appear on the ballot as follows: |
46 | PERMISSIBLE SUBJECT MATTER OF CONSTITUTIONAL |
47 | AMENDMENTS OR REVISIONS PROPOSED BY INITIATIVE |
48 | Proposes an amendment to Section 3 of Article XI of the |
49 | State Constitution to provide that a constitutional amendment or |
50 | revision proposed by initiative must amend or repeal an existing |
51 | section of the State Constitution on the same subject and |
52 | matter; must address a right of a citizen of this state |
53 | established in Article I of the State Constitution; or must |
54 | change the basic structure of state government as established in |
55 | Article II, Article III, Article IV, or Article V of the State |
56 | Constitution, except that no amendment or revision may deprive |
57 | the branches of government of any existing powers granted in |
58 | these articles. |
