| 6 | A joint resolution proposing an amendment to Section 3 of |
| 7 | Article XI of the State Constitution to provide the |
| 8 | permissible subject matter of revisions or amendments to |
| 9 | the State Constitution proposed by initiative. |

| 11 | Be It Resolved by the Legislature of the State of Florida: |
| 12 |
|
| 13 | That the amendment to Section 3 of Article XI of the State |
| 14 | Constitution set forth below is agreed to and shall be submitted |
| 15 | to the electors of Florida for approval or rejection at the |
| 16 | general election to be held in November 2006: |
| 17 | ARTICLE XI |
| 18 | AMENDMENTS |
| 19 | SECTION 3. Initiative.-- |
| 20 | (a) The power to propose the revision or amendment of any |
| 21 | portion or portions of this constitution by initiative is |
| 22 | reserved to the people, provided that, any such revision or |
| 23 | amendment, except for those limiting the power of government to |
| 24 | raise revenue, shall embrace but one subject and matter directly |
| 25 | connected therewith. Any revision or amendment proposed by |
| 26 | initiative shall: |
| 27 | (1) Amend or repeal an existing section of this |
| 28 | constitution on the same subject and matter; |
| 29 | (2) Address a basic or fundamental right of a citizen of |
| 30 | this state; or |
| 31 | (3) Change the basic structure of state government as |
| 32 | established in Article II, Article III, Article IV, or Article V |
| 33 | of this constitution, except that no revision or amendment shall |
| 34 | deprive the branches of government of any existing powers |
| 35 | granted in these articles. |
| 36 | (b) The initiative power It may be invoked by filing with |
| 37 | the custodian of state records a petition containing a copy of |
| 38 | the proposed revision or amendment, signed by a number of |
| 39 | electors in each of one half of the congressional districts of |
| 40 | the state, and of the state as a whole, equal to eight percent |
| 41 | of the votes cast in each of such districts respectively and in |
| 42 | the state as a whole in the last preceding election in which |
| 43 | presidential electors were chosen. |
| 44 | BE IT FURTHER RESOLVED that the title and substance of the |
| 45 | amendment proposed herein shall appear on the ballot as follows: |
| 46 | PERMISSIBLE SUBJECT MATTER OF CONSTITUTIONAL |
| 47 | REVISIONS OR AMENDMENTS PROPOSED BY INITIATIVE |
| 48 | Proposes an amendment to Section 3 of Article XI of the |
| 49 | State Constitution to provide that a constitutional revision or |
| 50 | amendment proposed by initiative must amend or repeal an |
| 51 | existing section of the State Constitution on the same subject |
| 52 | and matter; must address a basic or fundamental right of a |
| 53 | citizen of this state; or must change the basic structure of |
| 54 | state government as established in Article II, Article III, |
| 55 | Article IV, or Article V of the State Constitution, except that |
| 56 | no revision or amendment may deprive the branches of government |
| 57 | of any existing powers granted in these articles. |
