| 10 | Be It Enacted by the Legislature of the State of Florida: | 
| 11 | 
 | 
| 12 | Section 1.  Section 20.1971, Florida Statutes, is created | 
| 13 | to read: | 
| 14 | 20.1971  Agency for Persons with Disabilities; trust | 
| 15 | funds.--The following trust funds are created and shall be | 
| 16 | administered by the Agency for Persons with Disabilities: | 
| 17 | (2)  The Operations and Maintenance Trust Fund. | 
| 18 | (a)  Funds to be credited to the trust fund shall consist | 
| 19 | of receipts from third-party payors of health care services such | 
| 20 | as Medicaid. Funds shall be used for the purpose of providing | 
| 21 | health care services to agency clients and for other such | 
| 22 | purposes as may be appropriate and shall be expended only | 
| 23 | pursuant to legislative appropriation or an approved amendment | 
| 24 | to the agency's operating budget pursuant to the provisions of | 
| 25 | chapter 216. | 
| 26 | (b)  Notwithstanding the provisions of s. 216.301 and | 
| 27 | pursuant to s. 216.351, any balance in the trust fund at the end | 
| 28 | of any fiscal year shall remain in the trust fund at the end of | 
| 29 | the year and shall be available for carrying out the purposes of | 
| 30 | the trust fund. | 
| 31 | (c)  In accordance with s. 19(f)(2), Art. III of the State | 
| 32 | Constitution, the Operations and Maintenance Trust Fund shall, | 
| 33 | unless terminated earlier, be terminated on July 1, 2009. Before | 
| 34 | its scheduled termination, the trust fund shall be reviewed as | 
| 35 | provided in s. 215.3206(1) and (2). | 
| 36 | Section 2.  This act shall take effect on July 1, 2005. |
