11  Senator Rich moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 1, lines 12-14, delete those lines
15  
16  and insert:  
17         Section 1.  Subsection (4) and paragraph (a) of
18  subsection (6) of section 403.413, Florida Statutes, are
19  amended to read:
20         403.413  Florida Litter Law.--
21         (1)  SHORT TITLE.--This section may be cited as the
22  "Florida Litter Law."
23         (4)  DUMPING LITTER PROHIBITED.--Unless otherwise
24  authorized by law or permit, it is unlawful for any person to
25  dump litter in any manner or amount:
26         (a)  In or on any public highway, road, street, alley,
27  or thoroughfare, including any portion of the right-of-way
28  thereof, or any other public lands, except in containers or
29  areas lawfully provided therefor.  When any litter is thrown
30  or discarded from a motor vehicle, the operator or owner of
31  the motor vehicle, or both, shall be deemed in violation of

 1  this section;
 2         (b)  In or on any freshwater lake, river, canal, or
 3  stream or tidal or coastal water of the state, including
 4  canals.  When any litter is thrown or discarded from a boat,
 5  the operator or owner of the boat, or both, shall be deemed in
 6  violation of this section; or
 7         (c)  In or on any private property, unless prior
 8  consent of the owner has been given and unless the dumping of
 9  such litter by such person will not cause a public nuisance or
10  otherwise be in violation of any other state or local law,
11  rule, or regulation.

18  insert:
