1 A bill to be entitled
2 An act relating to the Florida Litter Law;
3 amending s. 403.413, F.S.; increasing the fine
4 for a noncriminal infraction of the Florida
5 Litter Law from $50 to $100; dedicating a
6 portion of the increase to the Solid Waste
7 Management Trust Fund; providing a use for such
8 funds; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (a) of subsection (6) of section
13 403.413, Florida Statutes, is amended to read:
14 403.413 Florida Litter Law.--
15 (6) PENALTIES; ENFORCEMENT.--
16 (a) Any person who dumps litter in violation of
17 subsection (4) in an amount not exceeding 15 pounds in weight
18 or 27 cubic feet in volume and not for commercial purposes is
19 guilty of a noncriminal infraction, punishable by a civil
20 penalty of $100, from which $50 shall be deposited into the
21 Solid Waste Management Trust Fund to be used for the solid
22 waste management grant program pursuant to s. 403.7095 $50. In
23 addition, the court may require the violator to pick up litter
24 or perform other labor commensurate with the offense
25 committed.
26 Section 2. This act shall take effect July 1, 2005.

4 The committee substitute provides that the $50 increase in the
litter fine shall be deposited into the Solid Waste Management
5 Trust Fund and used for the solid waste management grant
program pursuant to s. 403.7095, F.S.
