1 A bill to be entitled
2 An act relating to the State Homeland Security
3 Trust Fund; creating s. 288.833, F.S.; creating
4 the State Homeland Security Trust Fund, to be
5 administered by the Division of Emergency
6 Management within the Department of Community
7 Affairs; providing for sources of funds and
8 purposes; providing for review of requests for
9 funding; providing for annual carryforward of
10 unused funds; providing for review and
11 termination or re-creation of the trust fund;
12 providing a contingent effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 288.833, Florida Statutes, is
17 created to read:
18 288.833 State Homeland Security Trust Fund.--
19 (1) There is created the State Homeland Security Trust
20 Fund, to be administered by the Division of Emergency
21 Management within the Department of Community Affairs. Funds
22 shall be credited to the trust fund as provided in s.
23 288.857(4)(c), to be used to fund state homeland security with
24 priorities for funding to focus on costs not funded by the
25 Federal Government, such as operational costs of security at
26 seaports and other venues. Requests for funding shall be
27 reviewed by the Domestic Security Oversight Board which shall
28 provide recommended funding priorities.
29 (2) Notwithstanding the provisions of s. 216.301 and
30 pursuant to s. 216.351, any balance in the trust fund at the
31 end of any fiscal year shall remain in the trust fund at the

1 end of the year and shall be available for carrying out the
2 purposes of the trust fund.
3 (3) In accordance with s. 19(f)(2), Art. III of the
4 State Constitution, the State Homeland Security Trust Fund
5 shall be terminated on July 1, 2009, unless terminated sooner.
6 Before its scheduled termination, the trust fund shall be
7 reviewed as provided in s. 215.3206(1) and (2).
8 Section 2. This act shall take effect July 1, 2005, if
9 Senate Bill ____ or similar legislation creating the Travel To
10 and Commerce With Terrorist Nations Act is adopted in the same
11 legislative session or an extension thereof and becomes law.
