12  recommended the following substitute for amendment (613694):

14         Senate Amendment (with title amendment) 
15         On page 3, lines 4-21, delete those lines
16  
17  and insert:  
18         (4)  COMPETITIVE SELECTION.--
19         (b)1.  The agency shall select in order of preference
20  no fewer than three firms deemed to be the most highly
21  qualified to perform the required services. In determining
22  whether a firm is qualified, the agency shall consider such
23  factors as the ability of professional personnel; whether a
24  firm is a certified minority business enterprise; past
25  performance; willingness to meet time and budget requirements;
26  location; recent, current, and projected workloads of the
27  firms; and the volume of work previously awarded to each firm
28  by the agency, with the object of effecting an equitable
29  distribution of contracts among qualified firms, provided such
30  distribution does not violate the principle of selection of
31  the most highly qualified firms. The agency may request,

 1  accept, and consider proposals for the compensation to be paid
 2  under the contract only during competitive negotiations under
 3  subsection (5).
 4         2.  A local government may follow the process provided
 5  in this paragraph or adopt by ordinance an alternative process
 6  for its use.
