  1                      A bill to be entitled

  2         An act relating to the regulation of airports;

  3         amending s. 330.30, F.S.; prohibiting the

  4         Department of Transportation from renewing or

  5         reissuing licenses to certain general aviation

  6         airports that fail to develop a security plan;

  7         requiring that the plans be consistent with

  8         certain published guidelines; providing for

  9         review and approval of such plans by the

10         Department of Law Enforcement; requiring

11         periodic update of the plans; providing an

12         effective date.

13  

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (e) of subsection (2) of section

17  330.30, Florida Statutes, is amended, and paragraph (f) is

18  added to that subsection, to read:

19         330.30  Approval of airport sites; registration and

20  licensure of airports.--

21         (2)  LICENSES AND REGISTRATIONS; REQUIREMENTS, RENEWAL,

22  REVOCATION.--

23         (e)  The department may revoke, or refuse to allow or

24  issue, any airport registration or recertification, or any

25  license or license renewal, if it determines:

26         1.  That the site has been abandoned as an airport;

27         2.  That the airport does not comply with the

28  conditions of the license, license renewal, or site approval;

 1         3.  That the airport has become either unsafe or

 2  unusable for flight operation due to physical or legal changes

 3  in conditions that were the subject of approval; or.

 4         4.  That an airport required to file or update a

 5  security plan pursuant to paragraph (f) has failed to do so.

 6         (f)1.  After initial licensure or registration, a

 7  license or registration of a publicly or privately owned

 8  general aviation airport that is open to the public, that has

 9  at least one runway greater than 4,999 feet in length, and

10  that does not host scheduled passenger-carrying commercial

11  service operations regulated under 14 C.F.R. Part 139 shall

12  not be renewed, reissued, or recertified unless an approved

13  security plan has been filed with the department, except when

14  the department determines that the airport is working in good

15  faith toward completion and filing of the plan.

16         2.  Security plans required by this paragraph must be

17  developed in accordance with the 2004 Security Guidelines for

18  General Aviation Airports published by the United States

19  Department of Homeland Security Transportation Security

20  Administration or the 2004 Security Planning for General

21  Aviation Airports guidelines published by the Florida Airports

22  Council, and shall be reviewed and approved by the Department

23  of Law Enforcement prior to filing.

24         3.  The Department of Law Enforcement shall not approve

25  a security plan unless it is consistent with the

26  Transportation Security Administration's or Florida Airports

27  Council's guidelines and it has determined that the plan has

28  been developed appropriately to meet the particular security

29  needs of the airport for which it was created. Upon approval

30  of the security plan, the Department of Law Enforcement shall

31  notify the department of such approval.

 1         4.  An airport required to file a security plan

 2  pursuant to this paragraph shall update its plan at least once

 3  every 2 years after the initial filing date and file the

 4  updated plan with the department. The Department of Law

 5  Enforcement shall review the updated plan prior to filing to

 6  determine whether it has been updated appropriately to meet

 7  the particular security needs of the airport and shall report

 8  its determination to the department. No renewal license or

 9  registration recertification shall be issued to the airport,

10  or acknowledged by the department, unless the department

11  determines that the airport has updated the security plan or

12  is working in good faith to update it.

13         Section 2.  This act shall take effect October 1, 2005.
