18 Section 27. Subsection (1) of section 624.5091,
19 Florida Statutes, is amended to read:
20 624.5091 Retaliatory provision, insurers.--
21 (1)(a) When by or pursuant to the laws of any other
22 state or foreign country any taxes, licenses, and other fees,
23 in the aggregate, and any fines, penalties, deposit
24 requirements, or other material obligations, prohibitions, or
25 restrictions are or would be imposed upon Florida insurers or
26 upon the agents or representatives of such insurers, which are
27 in excess of such taxes, licenses, and other fees, in the
28 aggregate, or which are in excess of the fines, penalties,
29 deposit requirements, or other obligations, prohibitions, or
30 restrictions directly imposed upon similar insurers, or upon
31 the agents or representatives of such insurers, of such other

1 state or country under the statutes of this state, so long as
2 such laws of such other state or country continue in force or
3 are so applied, the same taxes, licenses, and other fees, in
4 the aggregate, or fines, penalties, deposit requirements, or
5 other material obligations, prohibitions, or restrictions of
6 whatever kind shall be imposed by the Department of Revenue
7 upon the insurers, or upon the agents or representatives of
8 such insurers, of such other state or country doing business
9 or seeking to do business in this state. In determining the
10 taxes to be imposed under this section, 80 percent and a
11 portion of the remaining 20 percent as provided in paragraph
12 (b) of the credit provided by s. 624.509(5), as limited by s.
13 624.509(6) and further determined by s. 624.509(7), shall not
14 be taken into consideration.
15 (b) As used in this subsection, the term "portion of
16 the remaining 20 percent" shall be calculated by multiplying
17 the remaining 20 percent by a fraction, the numerator of which
18 is the sum of the salaries qualifying for the credit allowed
19 by s. 624.509(5) of employees whose place of employment is
20 located in an enterprise zone created pursuant to chapter 290
21 and the denominator of which is the sum of the salaries
22 qualifying for the credit allowed by s. 624.509(5).
