1 A bill to be entitled
2 An act relating to paintball guns and markers;
3 defining the terms "paintball gun" and
4 "paintball marker"; prohibiting a person from
5 carrying a paintball gun or a paintball marker
6 in a vehicle on the highway; providing
7 specified exceptions; providing that the act
8 does not apply to a commercial paintball field,
9 range, or course operator when the operator
10 transports passengers to and from designated
11 player areas; providing that a person who
12 violates the act commits a misdemeanor of the
13 first degree; providing criminal penalties;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Paintball guns and paintball markers.--
19 (1) As used in this section, the term:
20 (a) "Paintball gun" means a device designed and
21 manufactured to propel, by gas or air, an encapsulated gelatin
22 paintball.
23 (b) "Paintball marker" means a device designed and
24 manufactured to propel, by gas or air, an encapsulated gelatin
25 paintball.
26 (2) Except as set forth in subsection (3), a person
27 may not carry a paintball gun or a paintball marker in a
28 vehicle on the highway unless:
29 (a) The paintball gun or paintball marker is
30 disassembled so that the propellant canister is separate from

1 the rest of the device and the device is empty of encapsulated
2 gelatin paintballs; or
3 (b) The propellant canister of the paintball gun or
4 paintball marker has been emptied of its gas or air propellant
5 and the device is empty of encapsulated gelatin paintballs.
6 (3) Subsection (2) does not apply to a commercial
7 paintball field, range, or course when passengers are being
8 transported by the commercial field, range, or course operator
9 to and from designated player areas.
10 (4) A person who violates this section commits a
11 misdemeanor of the first degree, punishable as provided in
12 section 775.082 or section 775.083, Florida Statutes.
13 Section 2. This act shall take effect July 1, 2005.

16 SENATE SUMMARY
17 Prohibits a person from carrying a paintball gun or a
