6 | 216.1817 Placement of positions in reserve; |
7 | reestablishment of positions.--If a procurement of contractual |
8 | services involves the performance of functions or |
9 | responsibilities that are being shifted from state employees to |
10 | a contractor, the agency shall identify within the business case |
11 | prepared pursuant to s. 287.0577 all resources which are |
12 | affected, including full-time equivalent positions. All full- |
13 | time equivalent positions identified in the business case shall |
14 | be placed in reserve by the Executive Office of the Governor |
15 | until the end of the second year of the contract. However, in |
16 | the business case, the agency may account for any savings from |
17 | the full-time equivalent positions identified and held in |
18 | reserve. Notwithstanding the provisions of s. 216.262, the |
19 | Executive Office of the Governor shall request authority from |
20 | the Legislative Budget Commission to reestablish full-time |
21 | equivalent positions above the number fixed by the Legislature |
22 | if a contract is terminated and the performance of the functions |
23 | or responsibilities must be returned to the agency. |
24 | Section 12. Section 287.074, Florida Statutes, is created |
25 | to read: |

28 | (1) Only a public officer or a public employee upon whom |
