5 | Section 7. (1) There is established the Lobbying Study |
6 | Group, consisting of nine members. The Speaker of the House of |
7 | Representatives shall appoint three members, one of whom shall |
8 | be a lobbyist; the President of the Senate shall appoint three |
9 | members, one of whom shall be a lobbyist; and the Governor shall |
10 | appoint three members, one of whom shall be a lobbyist. The |
11 | members shall serve for a term of 1 year each and submit a |
12 | report to the Speaker of the House of Representatives, the |
13 | President of the Senate, and the Governor by July 1, 2006. |
14 | (2) The study shall include, but not be limited to, the |
15 | following areas: |
16 | (a) The prohibition of lobbyists either to give gifts or |
17 | to give gifts under current limits with dual reporting. |
18 | (b) The prohibition of lobbying of parties or candidates |
19 | to: |
20 | 1. Make campaign contributions or solicitations for |
21 | contributions prior to qualifying; or |
22 | 2. Make campaign contributions during any meetings of the |
23 | Legislature, including interim committee meetings. |
24 | (c) The prohibition of legislative members from working |
25 | for an entity or government agency that employs a lobbyist or |
26 | that seeks appropriations. |
27 | (d) The prohibition of legislators from requesting from a |
28 | registered lobbyist or principal any funds for any purposes, |
29 | including charitable causes, without the legislator filing a |
30 | quarterly disclosure statement listing lobbyists that were |
31 | contacted. |
32 | (e) The prohibition of any legislator from soliciting for |
33 | a 527 from a lobbyist or principal without the legislator filing |
34 | a quarterly disclosure statement listing the lobbyist that was |
35 | contacted. |
36 | (f) The prohibition of campaign consultants from working |
37 | as a lobbyist or registering to lobby for 2 years after they |
38 | have had a contract for payment for campaign consulting with a |
39 | legislator or party. |
40 | (g) The prohibition of legislators' spouses and immediate |
41 | family members lobbying while such legislator is in office. |
42 | (h) The prohibition of in-kind contributions to any |
43 | political party from lobbyists or principals for any travel, |
44 | dining, or entertainment, including the use of any facilities |
45 | owned, leased, or under the control of the lobbyist or |
46 | principal. |
47 | (i) The prohibition of elected public officials from |
48 | soliciting or receiving federal or state campaign contributions |
49 | while serving as a state elected official. |
50 | (j) The prohibition of legislators, state parties, or |
51 | state appointed officials from recommending to any entity a |
52 | lobbyist for hire. |
53 | (k) A $100 expenditure limit per person for all food and |
54 | beverage consumed at one sitting. The reporting prohibition |
55 | against the listing of individual names would remain. The |
56 | lobbyist or principal must be in attendance at the event. |
57 | (l) The requirement of a "check-off" disclosure of areas |
58 | of lobbying interest in a timely manner on the lobbyist |
59 | disclosure statement either at registration or, in the case of |
60 | amended activities, within 48 hours of commencement of lobbying |
61 | activity. |
62 | (m) The requirement of exact dollar disclosure by the |
63 | lobbyist of all fees paid by public entities to the lobbyist. |
64 | (n) The requirement of audits of lobbyist records only |
65 | after an affirmative finding of probable cause on a filed |
66 | complaint. |
67 | (o) The requirement of electronic reporting, without |
68 | signatures, the use of the same opt-out as the executive branch, |
69 | and to require due dates to be the same as elections law, less |
70 | frequently during the interim. |
71 | (p) The prohibition of registered lobbyists from personal |
72 | campaign contributions unless the lobbyist is eligible to vote |
73 | for the candidate or lives in the district. |
74 | (3) This section applies to lobbyists to the legislative |
75 | and executive branches of state government and to local |
76 | governments. |
