5Remove lines 298 through 323, and insert:

7     163.3172  Urban infill and redevelopment.--In recognition
8that urban infill and redevelopment is a high state priority,
9the Legislature determines that local governments should not
10adopt charter provisions, ordinances, or land development
11regulations that discourage this state priority.  Higher density
12urban development is appropriate in urban core areas and should
13be encouraged in such locations.  Conversely, it is appropriate
14to discourage greater height and density as a development form
15in areas outside the urban core where such development forms are
16incompatible with existing land uses.  Notwithstanding chapters
17125 and 163 and s. 171.044(4), any existing or future charter
18county charter provision, ordinance, land development
19regulation, or countywide special act that governs the use,
20development, redevelopment, or voluntary annexation of land
21shall not be effective within or applicable to any municipality
22of the county unless the charter provision, ordinance, land
23development regulation, or countywide special act is approved by
24a majority vote of the electors within the county and a majority
25vote of the electors within the municipality, or is approved by
26a majority vote of the municipality's governing board.  Existing
27charter provisions and countywide special acts that have been
28approved by referendum prior to the effective date of this act
29must be readopted in accordance with this section.  However, in
30the event of a conflict between a countywide ordinance and a
31municipal ordinance within a charter county that regulates
32expressive conduct, the more restrictive ordinance shall govern.
33In addition, the requirements of this section restricting
34charter county provisions, ordinances, or land development
35regulations concerning building height restrictions shall not
36apply within any areas of critical state concern designated
37pursuant to ss. 380.05 ? 380.0555.
