| 8 | 775.21, Florida Statutes, are renumbered as subsections (9), |
| 9 | (10), and (11), respectively, and a subsection (8) is added to |
| 10 | said section, to read: |
| 11 | 775.21 The Florida Sexual Predators Act.-- |
| 12 | (8) Chemical castration.-A person designated a sexual |
| 13 | predator under this section shall be treated with |
| 14 | medroxyprogesterone acetate (MPA) as provided in s. 794.0235. |
| 15 | Section 25. Paragraph (b) of subsection (1) of section |
| 16 | 794.0235, Florida Statutes, is amended to read: |
| 17 | 794.0235 Administration of medroxyprogesterone acetate |
| 18 | (MPA) to persons convicted of sexual battery.-- |
| 19 | (1) Notwithstanding any other law, the court: |
| 20 | (b) Shall sentence a defendant to be treated with |
| 21 | medroxyprogesterone acetate (MPA), according to a schedule of |
| 22 | administration monitored by the Department of Corrections, if |
| 23 | the defendant is convicted of sexual battery as described in s. |
| 24 | 794.011 and the defendant has: |
| 25 | 1. A prior conviction of sexual battery under s. 794.011; |
| 26 | or |
| 27 | 2. Been designated a sexual predator under s. 775.21. |
| 28 |

| 29 | If the court sentences a defendant to be treated with |
| 30 | medroxyprogesterone acetate (MPA), the penalty may not be |
| 31 | imposed in lieu of, or reduce, any other penalty prescribed |
| 32 | under s. 794.011. However, in lieu of treatment with |
| 33 | medroxyprogesterone acetate (MPA), the court may order the |
| 34 | defendant to undergo physical castration upon written motion by |
| 35 | the defendant providing the defendant's intelligent, knowing, |
| 36 | and voluntary consent to physical castration as an alternative |
| 37 | penalty. |
