5 | Section 2. Subsections (2) and (5) of section 409.814, |
6 | Florida Statutes, are amended to read: |
7 | 409.814 Eligibility.--A child who has not reached 19 years |
8 | of age whose family income is equal to or below 200 percent of |
9 | the federal poverty level is eligible for the Florida KidCare |
10 | program as provided in this section. For enrollment in the |
11 | Children's Medical Services Network, a complete application |
12 | includes the medical or behavioral health screening. If, |
13 | subsequently, an individual is determined to be ineligible for |
14 | coverage, he or she must immediately be disenrolled from the |
15 | respective Florida KidCare program component. |
16 | (2) A child who is not eligible for Medicaid, but who is |
17 | eligible for the Florida KidCare program, may obtain health |
18 | benefits coverage under any of the other components listed in s. |
19 | 409.813 if such coverage is approved and available in the county |
20 | in which the child resides. However, a child who is eligible for |
21 | Medikids, including those eligible under subsection (5), may |
22 | participate in the Florida Healthy Kids program only if the |
23 | child has a sibling participating in the Florida Healthy Kids |
24 | program and the child's county of residence permits such |
25 | enrollment. |
26 | (5) A child whose family income is above 200 percent of |
27 | the federal poverty level or a child who is excluded under the |
28 | provisions of subsection (4) may apply for coverage and shall be |
29 | allowed to participate in the Florida KidCare program, excluding |
30 | the Medicaid program, but is subject to the following |
31 | provisions: |
32 | (a) The family is not eligible for premium assistance |
33 | payments and must pay the full cost of the premium, including |
34 | any administrative costs. |
35 | (b) The agency is authorized to place limits on enrollment |
36 | in Medikids by these children in order to avoid adverse |
37 | selection. The number of children participating in Medikids |
38 | whose family income exceeds 200 percent of the federal poverty |
39 | level must not exceed 10 percent of total enrollees in the |
40 | Medikids program. |
41 | (c) The board of directors of the Florida Healthy Kids |
42 | Corporation is authorized to place limits on enrollment of these |
43 | children in order to avoid adverse selection. In addition, the |
44 | board is authorized to offer a reduced benefit package to these |
45 | children in order to limit program costs for such families. The |
46 | number of children participating in the Florida Healthy Kids |
47 | program whose family income exceeds 200 percent of the federal |
48 | poverty level must not exceed 10 percent of total enrollees in |
49 | the Florida Healthy Kids program. |
50 | (d) Children described in this subsection are not counted |
51 | in the annual enrollment ceiling for the Florida KidCare |
52 | program. |
