A bill to be entitled
2An act relating to public records; creating s. 551.1078,
3F.S.; providing an exemption from public records
4requirements for nonessential private information supplied
5by applicants pursuant to an application filed for the
6purpose of securing a license as a slot machine licensee
7and trade secrets supplied by any entity under ch. 551,
8F.S., for licensing purposes; providing for review and
9repeal; providing a statement of public necessity;
10providing a contingent effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 551.1078, Florida Statutes, is created
15to read:
16     551.1078  Public records exemption; nonessential private
17information of applicants for licensure; trade secrets.--
18     (1)  Nonessential private information supplied by
19applicants pursuant to an application filed for the purpose of
20securing a license as a slot machine licensee and trade secrets
21supplied by any entity under this chapter for licensing purposes
22are exempt from s. 119.07(1) and s. 24(a), Art. I of the State
23Constitution.
24     (2)  Subsection (1) is subject to the Open Government
25Sunset Review Act of 1995 in accordance with s. 119.15 and shall
26stand repealed on October 2, 2010, unless reviewed and saved
27from repeal through reenactment by the Legislature.
28     Section 2.  It is the finding of the Legislature that
29nonessential private information supplied by applicants pursuant
30to an application filed for the purpose of securing a license as
31a slot machine licensee and trade secrets supplied by any entity
32under chapter 551, Florida Statutes, for licensing purposes must
33be kept confidential and exempt from s. 119.07(1) and s. 24(a),
34Art. I of the State Constitution in order to protect sensitive
35personal and financial information contained in applications
36filed with the Division of Slot Machines of the Department of
37Business and Professional Regulation and to protect confidential
38information about entities filing such applications.
39     Section 3.  This act shall take effect on the same date
40that HB 1901 or similar legislation takes effect, if such
41legislation is adopted in the same legislative session or an
42extension thereof and becomes law.
