12 recommended the following amendment:

14 Senate Amendment (with title amendment)
15 On page 2, between lines 24 and 25,
16
17 insert: (h) For the purposes of this subsection,
18 construction and demolition materials shall be weighed at the
19 materials recovery facility prior to any unloading or
20 processing. Any materials that are transported from such
21 materials recovery facility must be weighed prior to
22 transport. The owner or operator of a materials recovery
23 facility that accepts or processes construction and demolition
24 materials shall, upon the request of a local government,
25 provide the following documentation for any solid waste
26 generated or transported from the facility:
27 1. The amount and type of construction and demolition
28 materials handled at the facility;
29 2. The amount of materials being disposed of and the
30 disposal site location; or
31 3. The name of the person with whom such disposal was

2 (4) Notwithstanding any provision of this section to
3 the contrary, any franchise agreement or contract granting
4 exclusive collections for construction and demolition debris
5 or recovered construction and demolition materials that is in
6 existence may remain in effect until its expiration date.

11 On page 1, line 14, after "certified;"

13 and insert:
14 requiring owners and operators of materials
15 recovery facilities to provide certain
16 documentation for any solid waste generated or
17 transported from the facilities; providing
18 applicability to certain existing franchise
19 agreements and contracts;
