11 Senator Baker moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 39, between lines 20 and 21,

16 insert:
17 Section 34. Subsections (5) and (6) are added to
18 section 943.135, Florida Statutes, to read:
19 943.135 Requirements for continued employment.--
20 (5) An employing agency as defined in s. 943.10 (4)
21 may require a law enforcement officer and correctional officer
22 as defined in s. 943.10 (1), (2), or (3) to successfully pass
23 a physical examination in order to be eligible for the
24 presumption set forth in s. 112.18. The employing agency shall
25 have the physical examination performed prior to or
26 immediately upon employment of the officer. This provision
27 shall not affect the applicability of the presumption set
28 forth in s. 112.18 for law enforcement officers or
29 correctional officers who are currently employed by an
30 employing agency.
31 (6) An employing agency as defined in s. 943.10 (4)

1 may set tobacco use standards for law enforcement officers and
2 correctional officers as defined in s. 943.10 (1), (2), or (3)
3 employed by a municipality, county, political subdivision of
4 the state of any agent of the political subdivision who has
5 constitutional authority or statutory authority to employ or
6 appoint an officer.
