14 On page 39, between lines 20 and 21,

16 insert:
17 Section 34. Paragraph (h) is added to subsection (1)
18 of section 400.9935, Florida Statutes, and subsection (13) is
19 added to that section, to read:
20 400.9935 Clinic responsibilities.--
21 (1) Each clinic shall appoint a medical director or
22 clinic director who shall agree in writing to accept legal
23 responsibility for the following activities on behalf of the
24 clinic. The medical director or the clinic director shall:
25 (h) Not refer patients to the clinic if the clinic
26 performs magnetic resonance imaging, static radiographs,
27 computed tomography, or positron emission tomography. The term
28 "refer patients" means referring one or more patients of the
29 medical or clinic director or a member of the medical or
30 clinic director's group practice to the clinic for magnetic
31 resonance imaging, static radiographs, computed tomography, or

1 positron emission tomography. A medical or clinic director who
2 violates this paragraph commits a felony of the third degree,
3 punishable as provided in s. 775.082, s. 775.083, or s.
4 775.084.
5 (13) The clinic shall display a sign in a conspicuous
6 location which is readily visible to all patients indicating
7 that, pursuant to s. 626.9892, the Department of Financial
8 Services may pay rewards of up to $25,000 to persons providing
9 information leading to the arrest and conviction of persons
10 committing crimes investigated by the Division of Insurance
11 Fraud arising from violations of s. 440.105, s. 624.15, s.
12 626.9541, s. 626.989, or s. 817.234. An authorized employee of
13 the Division of Insurance Fraud may make unannounced
14 inspections of a clinic licensed under this part as necessary
15 to determine whether the clinic is in compliance with this
16 subsection. A licensed clinic must allow complete access to
17 the premises to such employee.
