13         Senate Amendment (with title amendment) 
14         On page 38, between lines 25 and 26,
15  
16  insert:  
17         Section 31.  Paragraph (l) of subsection (1) of section
18  626.9541, Florida Statutes, is amended, and paragraph (cc) is
19  added to that subsection, to read:
20         626.9541  Unfair methods of competition and unfair or
21  deceptive acts or practices defined.--
22         (1)  UNFAIR METHODS OF COMPETITION AND UNFAIR OR
23  DECEPTIVE ACTS.--The following are defined as unfair methods
24  of competition and unfair or deceptive acts or practices:
25         (l)  Twisting.--Knowingly making any misleading
26  representations or incomplete or fraudulent comparisons or
27  fraudulent material omissions of or with respect to any
28  insurance policies, including those of the National Flood
29  Insurance Program or its successors, or insurers for the
30  purpose of inducing, or tending to induce, any person to
31  lapse, forfeit, surrender, terminate, retain, pledge, assign,

 1  borrow on, or convert any insurance policy, including a policy
 2  of the National Flood Insurance Program, or to take out a
 3  policy of insurance in another insurer. It is a violation of
 4  this subsection for any individual or entity to receive direct
 5  payment from the National Flood Insurance Program, the Federal
 6  Emergency Management Agency, or any write-your-own flood
 7  carrier of any unearned premium due a policyholder except for
 8  an individual who is a relative of any such policyholder.
