14 On lines 48-61, delete those lines
15
16 and insert:
17 (3) Notwithstanding any law to the contrary, in order
18 to maintain a class action seeking monetary relief, the class
19 must allege and prove actual or statutory damages. In any such
20 class action, the monetary recovery shall be limited to the
21 amount of actual and statutory damages. Nothing in this
22 section shall be construed to limit or restrict the ability of
23 the Attorney General to bring a class action for the recovery
24 of statutory penalties, if otherwise authorized by law.
25 However, class action claimants may seek to obtain, if
26 appropriate, nonmonetary relief, including injunctive relief
27 and orders, declaratory relief and orders or judgments
28 enjoining wrongful conduct, or equitable relief, regardless of
29 whether the class action claimants can prove any actual
30 monetary damages. Nothing in this section shall be construed
31 to in any way limit or restrict the availability of such
