11 The Committee on Transportation (Sebesta) recommended the
12 following substitute for amendment (342166):

14 Senate Amendment (with title amendment)
15 On page 2, line 15 through page 3 line 6, delete those
16 lines

18 and insert:
19 (b) It is unlawful for any operator of a pickup truck
20 or flatbed truck to permit a minor child who has not attained
21 18 years of age to ride upon limited access facilities of the
22 state within the open body of the pickup truck or flatbed
23 truck unless the minor is restrained within the open body in
24 the back of a truck which has been modified to include secure
25 seating and safety restraints that would prevent the minor
26 from being thrown, falling, or jumping from the truck. This
27 paragraph does not apply in a medical emergency if the child
28 is accompanied within the truck by an adult. A county is
29 exempt from this paragraph if the governing body of the
30 county, by majority vote, following a duly noticed public
31 hearing, votes to exempt the county from this paragraph.

1 (c) Any person who violates the provisions of this subsection
2 shall be cited for a nonmoving violation, punishable as
3 provided in chapter 318.
4 (3) This section shall not apply to a performer
5 engaged in a professional exhibition or person participating
6 in an exhibition or parade, or any such person preparing to
7 participate in such exhibitions or parades.

12 On page 1, lines 10 through 13 delete

14 and insert:

17 counties to be exempted under certain

19 penalties; providing an effective date.
