12 | Be It Enacted by the Legislature of the State of Florida: |

14 | Section 1. Paragraph (a) of subsection (5) of section |
15 | 252.37, Florida Statutes, is amended to read: |
16 | 252.37 Financing.-- |
17 | (5) Unless otherwise specified in the General |
18 | Appropriations Act: |
19 | (a) Whenever the state accepts financial assistance from |
20 | the Federal Government or its agencies under the federal Public |
21 | Assistance Program and such financial assistance is conditioned |
22 | upon a requirement for matching funds, the state shall provide |
23 | the entire match requirement for state agencies and one-half of |
24 | the required match for grants to local governments and private |
25 | nonprofit organizations eligible for such public assistance |
26 | under the federal Public Assistance Program, excluding |
27 | educational institutions. The affected local government or |
28 | private nonprofit organization shall be required to provide one- |
29 | half of the required match prior to receipt of such financial |
30 | assistance. For purposes of this subsection, the term "local |
31 | government" means a municipality, a county, or a political |
32 | subdivision and the term "state agency" means a state officer, a |
33 | state department, a departmental unit described in s. 20.04, a |
34 | state university, a community college, or a district school |
35 | board. |
36 | Section 2. This act shall take effect upon becoming a law |
37 | and shall operate retroactively to July 1, 2004. |
