3     Amendment (with title amendment)
4     Between lines 2710 and 2711, insert:
5     Section 57.  Subsection (3) is added to section 939.185,
6Florida Statutes, to read:
7     939.185  Assessment of additional court costs and
8surcharges.--
9     (3)  In addition to the court costs imposed under
10subsection (1) and any other cost, fine, or penalty imposed by
11law, any unit of local government which is consolidated as
12provided by s. 9, Art. VIII of the State Constitution of 1885,
13as preserved by s. 6(e), Art. VIII of the State Constitution of
141968, and which is granted the authority in the State
15Constitution to exercise all the powers of a municipal
16corporation, and any unit of local government operating under a
17home rule charter adopted pursuant to ss. 10, 11, and 24, Art.
18VIII of the State Constitution of 1885, as preserved by s. 6(e),
19Art. VIII of the State Constitution of 1968, which is granted
20the authority in the State Constitution to exercise all the
21powers conferred now or hereafter by general law upon
22municipalities, may impose by ordinance a surcharge in the
23amount of $85 to be imposed by the court when a person pleads
24guilty or nolo contendere to, or is found guilty of, any felony,
25misdemeanor, or criminal traffic offense under the laws of this
26state. Revenue from the surcharge shall be transferred to such
27unit of local government for the purpose of replacing fine
28revenue deposited into the clerk's fine and forfeiture fund
29under s. 142.01. The court may not waive this surcharge.

35authorizing certain local governments to impose by ordinance in
36addition to certain court costs and other costs, fines, and
37penalties imposed by law a surcharge to be imposed by court on
38persons pleading guilty or nolo contendere to certain criminal
39offenses; providing for transfer of revenues from such surcharge
40for certain purposes; prohibiting a court from waiving the
41surcharge; amending s. 985.05,
