5 | (6) The Legislative Budget Commission may approve |
6 | increases to the maximum annual budgets approved for individual |
7 | clerks of the court pursuant to s. 28.36 for court related |
8 | duties, if either of the following conditions exist: |
9 | (a) The additional funding is necessary to pay the cost of |
10 | performing new or additional functions required by changes in |
11 | law or court rule. Before the Legislative Budget Commission may |
12 | approve an increase in the maximum annual budget of any clerk |
13 | under this paragraph, the Clerk of the Court Operations |
14 | Corporation must provide the Legislative Budget Commission with |
15 | a statement of the impact of the proposed budget changes on |
16 | state revenues, and evidence that the respective clerk of the |
17 | court is meeting or exceeding the established performance |
18 | standards for measures on the fiscal management, operational |
19 | efficiency, and effective collection of fines, fees, service |
20 | charges, and court costs. |
21 | (b) The additional funding is necessary to pay the cost of |
22 | supporting increases in the number of judges or magistrates |
23 | authorized by the Legislature. Before the Legislative Budget |
24 | Commission may approve an increase in the maximum annual budget |
25 | of any clerk under this paragraph, the Clerk of the Court |
26 | Operations Corporation must provide the Legislative Budget |
27 | Commission with a statement of the impact of the proposed budget |
28 | changes on state revenues; evidence that the respective clerk of |
29 | the court is meeting or exceeding the established performance |
30 | standards for measures on the fiscal management, operational |
31 | efficiency, and effective collection of fines, fees, service |
32 | charges, and court costs; and a proposed staffing model, |
33 | including the cost and number of staff necessary to support each |
34 | new judge or magistrate. |

36 | The total amount of increases approved by the Legislative Budget |
37 | Commission for each county fiscal year shall not exceed an |
38 | amount equal to 2 percent of the maximum annual budgets approved |
39 | pursuant to s. 28.36 for all clerks, in the aggregate, for that |
40 | same county fiscal year. |
