5 | 29.015 Contingency fund; limitation of authority to |
6 | transfer funds in contracted due process services appropriation |
7 | categories.-- |
8 | (2) In the event that a state attorney or public defender |
9 | incurs a deficit in a contracted due process services |
10 | appropriation category, the following steps shall be taken in |
11 | order: |
12 | (a) The state attorney or public defender shall first |
13 | attempt to identify surplus funds from other appropriation |
14 | categories within his or her office and submit a budget |
15 | amendment pursuant to chapter 216 to transfer funds from within |
16 | the office. |
17 | (b) In the event that the state attorney or public |
18 | defender is unable to identify surplus funds from within his or |
19 | her office, he or she shall certify this to the Justice |
20 | Administrative Commission along with a complete explanation of |
21 | the circumstances which led to the deficit and steps the office |
22 | has taken to reduce or alleviate the deficit. The Justice |
23 | Administrative Commission shall inquire as to whether any other |
24 | office has surplus funds in its contracted due process services |
25 | appropriation categories which can be transferred to the office |
26 | that is experiencing the deficit. If other offices indicate that |
27 | surplus funds are available within the same appropriation |
28 | category, the Justice Administrative Commission shall transfer |
29 | the amount needed to fund the deficit and notify the Governor |
30 | and the chair and vice chair of the Legislative Budget |
31 | Commission 14 days prior to a transfer pursuant to the notice, |
32 | review, and objection provisions of s. 216.177. If funds |
33 | appropriated for this purpose are available in a different |
34 | budget entity, the Justice Administrative Commission shall |
35 | request a budget amendment pursuant to chapter 216 request a |
36 | budget amendment to transfer funds from the office or offices to |
37 | alleviate the deficit upon agreement of the contributing office |
38 | or offices. |
