5 | Section 57. Subsection (2) of section 985.05, Florida |
6 | Statutes, is amended, and subsection (5) is added to said |
7 | section, to read: |
8 | 985.05 Court records.-- |
9 | (2) The clerk shall keep all official records required by |
10 | this section separate from other records of the circuit court, |
11 | except those records pertaining to motor vehicle violations, |
12 | which shall be forwarded to the Department of Highway Safety and |
13 | Motor Vehicles. Except as provided in ss. 943.053 and 985.04(4), |
14 | official records required by this part are not open to |
15 | inspection by the public, but may be inspected only upon order |
16 | of the court by persons deemed by the court to have a proper |
17 | interest therein, except that a child and the parents, |
18 | guardians, or legal custodians of the child and their attorneys, |
19 | law enforcement agencies, the Department of Juvenile Justice and |
20 | its designees, the Parole Commission, and the Department of |
21 | Corrections, and the Justice Administrative Commission shall |
22 | always have the right to inspect and copy any official record |
23 | pertaining to the child. The court may permit authorized |
24 | representatives of recognized organizations compiling statistics |
25 | for proper purposes to inspect, and make abstracts from, |
26 | official records under whatever conditions upon the use and |
27 | disposition of such records the court may deem proper and may |
28 | punish by contempt proceedings any violation of those |
29 | conditions. |
30 | (5) This part does not prohibit a circuit court from |
31 | providing a restitution order containing the information |
32 | prescribed in s. 985.201(4)(c) to a collection court or a |
33 | private collection agency for the sole purpose of collecting |
34 | unpaid restitution ordered in a case in which the circuit court |
35 | has retained jurisdiction over the child and the child's parent |
36 | or legal guardian. The collection court or private collection |
37 | agency shall maintain the confidential status of the information |
38 | to the extent such confidentiality is provided by law. |
