4     Between lines 2090 and 2091, insert:
5     Section 34.  Section 59.061, Florida Statutes, is created
6to read:
7     59.061  Legislative intent; appeal from nonfinal orders
8based on claims or defenses arising under free speech or free
9press clause of the First Amendment, s. 4, Art. I of the State
10Constitution, or chapter 770.--It is the intent of the
11Legislature that a party has the right to appeal to the district
12courts of appeal a nonfinal order denying a motion for summary
13judgment based upon a claim against or defense by a party whose
14communication appears in or is published by the electronic or
15print media, or a member of the electronic or print media,
16acting in such capacity, arising under the free speech or free
17press clause of the First Amendment to the United States
18Constitution, s. 1, Art. I, of the State Constitution, or
19chapter 770. Such summary judgment orders that may be appealed
20include, but are not limited to, orders addressing free speech
21or free press claims or defenses in actions for libel or
22slander, invasion of privacy, or any other tort founded upon a
23publication or broadcast.
