  1                      A bill to be entitled

  2         An act relating to the code of ethics for

  3         public officers and employees; amending s.

  4         112.313, F.S.; providing that it is a conflict

  5         of interest for a member of the Legislature to

  6         accept compensation from an agency or business

  7         entity receiving state funds under specified

  8         circumstances; providing penalties; providing

  9         an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (17) is added to section

14  112.313, Florida Statutes, to read:

15         112.313  Standards of conduct for public officers,

16  employees of agencies, and local government attorneys.--

17         (17)  LEGISLATORS; ADDITIONAL PROVISIONS.--It is a

18  conflict of interest for a member of the Legislature to

19  receive compensation from any agency or business entity that,

20  directly or indirectly, receives state funds. However, this

21  subsection does not apply if the member receives compensation

22  for any service provided as part of the member's regular

23  occupation or profession when that service has been procured

24  by the agency or business entity through a selection process

25  in which the status of the member is not known to the agency

26  or business entity or in which such status can be, and is,

27  disregarded if known.

28         Section 2.  This act shall take effect January 1, 2014.

 2                          SENATE SUMMARY

 3    Provides that it is a conflict of interest for a member
      of the Legislature to receive compensation from an agency
 4    or business entity receiving state moneys unless the
      member receives such compensation for services in his or
 5    her regular profession or occupation and his or her
      selection to perform the services is accomplished in
 6    ignorance of, or without regard to, the member's status.
