1 A bill to be entitled
2 An act relating to regulating legislative
3 lobbying; amending s. 11.045, F.S.; providing
4 that it is a conflict of interest for a person
5 registered to lobby the Legislature to serve on
6 a governing or advisory body of an entity that
7 receives state funds if the person's position
8 on the body is subject to gubernatorial or
9 legislative appointment; providing penalties;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (7) of section 11.045, Florida
15 Statutes, is amended, and subsection (9) is added to that
16 section, to read:
17 11.045 Lobbyists; registration and reporting;
18 exemptions; penalties.--
19 (7) Any person required to be registered or to provide
20 information pursuant to this section or pursuant to rules
21 established in conformity with this section who knowingly
22 fails to disclose any material fact required by this section
23 or by rules established in conformity with this section, or
24 who knowingly provides false information on any report
25 required by this section or by rules established in conformity
26 with this section, or who knowingly violates subsection (9)
27 commits a noncriminal infraction, punishable by a fine not to
28 exceed $5,000. Such penalty shall be in addition to any other
29 penalty assessed by a house of the Legislature pursuant to
30 subsection (6).

1 (9) It is a conflict of interest for any person
2 registered under this section to serve on the governing body
3 of, or a body that is advisory to, any entity that directly or
4 indirectly receives state funds if the person's position on
5 that body depends upon gubernatorial or legislative
6 appointment thereto.
7 Section 2. This act shall take effect on the first
8 Wednesday after the first Tuesday in November 2008.

11 SENATE SUMMARY
12 Provides that it is a conflict of interest, subject to a
fine as a noncriminal infraction, for a legislative
13 lobbyist to serve on the governing body or an advisory
body of an entity that receives state funds if the
14 person's position on the body is one subject to
gubernatorial or legislative appointment.
