  1                      A bill to be entitled

  2         An act relating to certification of water

  3         management activities; creating s. 373.1175,

  4         F.S.; providing for requirements that a

  5         professional geologist sign and seal specified

  6         documents; prescribing responsibility for the

  7         costs of such signing and sealing; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 373.1175, Florida Statutes, is

13  created to read:

14         373.1175  Signing and sealing by professional

15  geologists.--

16         (1)  If an application for a permit or license, or the

17  performance of an activity regulated under this chapter,

18  requires the services of a professional geologist as provided

19  for in chapter 492, the department or governing board of a

20  water management district may require that a professional

21  geologist licensed under chapter 492 sign and seal any

22  documents and reports submitted in connection with the permit

23  application or regulated activity.

24         (2)  The cost of such signing and sealing by a

25  professional geologist shall be borne by the permit applicant

26  or permittee.

27         (3)  Nothing in this section shall be construed to

28  prevent or prohibit the practice by professional engineers

29  pursuant to chapter 471.

30         Section 2.  This act shall take effect July 1, 2005.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1988

 4  The committee substitute deletes the provisions that created
    s. 373.1165, F.S., which provided for certification of certain
 5  professionals regulated under ch. 373, F.S., ch. 376, F.S., or
    a delegated permitting program under a water management
 6  district.
