  1                      A bill to be entitled

  2         An act relating to attorney's fees; amending s.

  3         627.428, F.S.; prohibiting the application of a

  4         contingency risk multiplier in the award of

  5         attorney's fees in suits based on claims

  6         arising under the Florida Motor Vehicle

  7         No-Fault Law except in certain circumstances;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (4) is added to section 627.428,

13  Florida Statutes, to read:

14         627.428  Attorney's fee.--

15         (4)  As to suits based on claims arising under ss.

16  627.730-627.7405, a contingency risk multiplier may not be

17  applied to adjust attorney's fees unless the court finds that

18  the case was exceptional in that it resulted in a decision

19  creating new law.

20         Section 2.  This act shall take effect July 1, 2005.
