11  The Committee on Health Care (Peaden) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 2, between lines 9 and 10,
16  
17  insert:  
18         Section 2.  Paragraph (k) is added to subsection (3) of
19  section 409.907, Florida Statutes, to read:
20         409.907  Medicaid provider agreements.--The agency may
21  make payments for medical assistance and related services
22  rendered to Medicaid recipients only to an individual or
23  entity who has a provider agreement in effect with the agency,
24  who is performing services or supplying goods in accordance
25  with federal, state, and local law, and who agrees that no
26  person shall, on the grounds of handicap, race, color, or
27  national origin, or for any other reason, be subjected to
28  discrimination under any program or activity for which the
29  provider receives payment from the agency.
30         (3)  The provider agreement developed by the agency, in
31  addition to the requirements specified in subsections (1) and

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 1994 Barcode 251196 1 (2), shall require the provider to: 2 (k) If a hospital is licensed under chapter 395 and 3 its facilities are owned in whole or in part by a municipality 4 or county, affirm that: 5 1. The hospital has established binding procedures 6 when purchasing or contracting for medical supplies to 7 ascertain for each considered vendor the approximate number of 8 full-time employees located in this state, whether the vendor 9 maintains its corporate books and records in this state, 10 whether the vendor agrees to provide access voluntarily to 11 appropriate regulatory agencies to its books and records 12 related to Medicaid, and whether the account will be primarily 13 serviced by Florida employees; and 14 2. When cost, quality, and service are not 15 significantly different, the hospital shall exercise a 16 contracting preference for vendors that use the greater number 17 of employees residing in this state in the operation and 18 servicing of the vendor's business for the hospital and for 19 those vendors that also provide voluntary access in this state 20 to appropriate regulatory agencies to records related to 21 Medicaid. 22 23 (Redesignate subsequent sections.) 24 25 26 ================ T I T L E A M E N D M E N T =============== 27 And the title is amended as follows: 28 On page 1, line 6, after the semicolon, 29 30 insert: 31 amending s. 409.907, F.S.; requiring a hospital 2 2:35 PM 04/05/05 s1994c-he02-ta1
