11 The Committee on Education (Webster) recommended the following
12 amendment:

15 On page 20, line 20, through
16 page 23, line 18, delete those lines

18 and insert:
19 (b) A private school participating in the John M.
20 McKay Scholarships for Students with Disabilities Program must
21 ensure that each employee with direct student contact is of
22 good moral character; is subject to the level 1 background
23 screening as provided under chapter 453; is denied employment,
24 or terminated from employment, if required under s. 435.06;
25 and is not ineligible to teach in a public school because his
26 or her educator certificate is suspended or revoked. This
27 requirement does not apply to an individual who holds a valid
28 Florida teaching certificate and who has been fingerprinted
29 under s. 1012.32. A school that continues to employ an
30 individual after notification that the individual has failed
31 the level 1 background screening is not eligible to

1 participate in the John M. McKay Scholarships for Students
2 with Disabilities Program and may not provide scholarships
3 under that program. As used in this paragraph, the term
4 "employee with direct student contact" means an individual,
5 paid by the school to provide a service or fill a position,
6 who has unsupervised access to a scholarship student of the
7 school. The costs of fingerprinting and the background check
8 may not be borne by the state.

15 and insert:

20 not bear the cost of the background check;
