16 page 35, line 20, delete those lines

18 and insert:
19 Section 3. (1) A private school that meets the
20 following requirements on June 1, 2005, is not required to
21 meet the requirements in section 1002.39(4)(a)1., Florida
22 Statutes:
23 (a) The private school is participating in the McKay
24 Scholarship Program under section 1002.39, Florida Statutes;
25 and
26 (b) The private school is determined by the Department
27 of Education to be in compliance with section 1002.39, Florida
28 Statutes.
29 (2) Notwithstanding section 1002.39(4)(b)4., Florida
30 Statutes, a private school that meets the requirements in
31 paragraphs (1)(a) and (b) may accept a McKay Scholarship

2 (3) Notwithstanding subsections (1) and (2), if the
3 private school becomes, after June 1, 2005, subject to an
4 action taken by the Department of Education for any violation
5 of section 1002.39, Florida Statutes, the private school:
6 (a) Shall file a surety bond with the Department of
7 Education following the date on which the action was taken
8 against the private school for a violation of section 1002.39,
9 Florida Statutes, but prior to receiving the next quarterly
10 payment;
11 (b) Shall file a surety bond with the Department of
12 Education for 1 additional consecutive year thereafter; and
13 (c) May not accept new McKay Scholarship students
14 until the private school complies with all the requirements in
15 section 1002.39, Florida Statutes, and all applicable rules of
16 the State Board of Education, as determined by the Department
17 of Education.
