11 The Committee on Education (Webster) recommended the following
12 amendment:

15 On page 48, line 3, through
16 page 50, line 29, delete those lines

18 and insert:
19 (g) Ensure that each employee with direct student
20 contact is of good moral character; is subject to the level 1
21 background screening as provided under chapter 453; is denied
22 employment, or terminated from employment, if required under
23 s. 435.06; and is not ineligible to teach in a public school
24 because his or her educator certificate is suspended or
25 revoked. This requirement does not apply to an individual who
26 holds a valid Florida teaching certificate and has been
27 fingerprinted under s. 1012.32. A school that continues to
28 employ an individual after notification that the individual
29 has failed the level 1 background screening is not eligible to
30 participate in the John M. McKay Scholarships for Students
31 with Disabilities Program and may not provide scholarships

1 under that program. As used in this paragraph, the term
2 "employee with direct student contact" means an individual,
3 paid by the school to provide a service or fill a position,
4 who has unsupervised access to a scholarship student of the
5 school. The costs of fingerprinting and the background check
6 may not be borne by the state.
