11 The Committee on Education Appropriations (Wise) recommended
12 the following amendment:

14 Senate Amendment (with title amendment)
15 On page 55, lines 18-31, delete those liens
16
17 and insert:
18 (h) Identify all nationally norm-referenced test that
19 are comparable to the norm-referenced test portions of the
20 Florida Comprehensive Assessment Test (FCAT).
21 (i) Select an independent private research
22 organization to which participating private schools must
23 report the scores of participating students on the nationally
24 norm-referenced tests administered by the private school. The
25 independent private research organization must annually report
26 to the Department of Education on the year-to-year
27 improvements of participating students; must analyze and
28 report student performance data in a manner that protects the
29 rights of students and parents as mandated in 20 U.S.C. s.
30 1232g; and must not dissaggregate data to a level that will
31 disclose the academic level of individual students or of

1 individual schools. To the extent possible, the organization
2 must accumulate historical performance data on students from
3 the Department of Education and private schools to describe
4 baseline performance and conduct longitudinal studies. To
5 minimize costs and reduce time required for third-party
6 analysis and evaluation, the Department of Education shall
7 conduct analyses of matched students from public school
8 assessment data and calculate control group learning gains
9 using an agreed-upon methodology outlined in the contract with
10 the third-party evaluator. The sharing of student data must be
11 in accordance with 20 U.S.C. 1232g, and shall be for the sole
12 purpose of conducting the evaluation. All parties must
13 preserve the confidentiality of such information as required
14 by law.
