11 The Committee on Education Appropriations (Wise) recommended
12 the following amendment to amendment (073776):

14 Senate Amendment (with title amendment)
15 On page 11, line 17, through
16 page 14, line 26, delete those lines
17
18 and insert: with scholarship students to be of good moral
19 character, to be subject to the level 1 background screening
20 as provided under chapter 435, to be denied employment or
21 terminated if required under s. 435.06, and not to be
22 ineligible to teach in a public school because his or her
23 educator certificate is suspended or revoked. For purposes of
24 this paragraph:
25 1. An "individual with direct student contact" means
26 any individual who has unsupervised access to a scholarship
27 student for whom the private school is responsible.
28 2. The costs of fingerprinting and the background
29 check shall not be borne by the state.
30 3. Continued employment of an individual after
31 notification that the individual has failed the level 1

1 background screening shall cause a private school to be
2 ineligible for participation in the John M. McKay Scholarships
3 for Students with Disabilities Program.
4 4. An individual holding a valid Florida teaching
5 certificate who has been fingerprinted pursuant to s. 1012.32
6 is not required to comply with this paragraph.
