15 On page 40, line 27, through
16 page 42, line 4, delete those lines
17
18 and insert:
19 (d) The amount of an eligible contribution which may
20 be accepted by an eligible nonprofit scholarship-funding
21 organization is limited to the amount needed to provide
22 scholarships for qualified students which the organization has
23 identified and for which vacancies in eligible nonpublic
24 schools have been identified.
25 (d)(e) An eligible nonprofit scholarship-funding
26 organization that receives an eligible contribution must spend
27 100 percent of the eligible contribution to provide
28 scholarships in the same state fiscal year in which the
29 contribution was received. No portion of eligible
30 contributions may be used for administrative expenses. All
31 interest accrued from contributions must be used for

1 scholarships.
2 (e)(f) An eligible nonprofit scholarship-funding
3 organization that receives eligible contributions must, within
4 180 days after the end of the organization's fiscal year,
5 provide to the Auditor General and the Department of Education
6 an annual financial and compliance audit of its accounts and
7 records conducted by an independent certified public
8 accountant and in accordance with rules adopted by the Auditor
9 General. The Auditor General shall review all audit reports
10 submitted pursuant to this section. The Auditor General shall
11 request any significant items that were omitted in violation
12 of a rule adopted by the Auditor General. The items must be
13 provided within 45 days after the date of the request. If the
14 eligible nonprofit scholarship-funding organization does not
15 comply with the Auditor General's request, the Auditor General
16 shall notify the Legislative Auditing Committee. The
17 Legislative Auditing Committee may schedule a hearing. If a
18 hearing is scheduled, the committee shall determine if the
19 eligible nonprofit scholarship-funding organization should be
20 subject to further state action. If the committee determines
21 that the eligible nonprofit scholarship-funding organization
22 should be subject to further state action, the committee shall
23 notify the Department of Education, which shall terminate the
24 eligibility of the eligible nonprofit scholarship-funding
25 organization to participate in the program under this section.
