  1                      A bill to be entitled

  2         An act relating to the Florida Hazardous

  3         Materials Emergency Response and Community

  4         Right-to-Know Act; updating a reference to a

  5         federal list of hazardous substances for which

  6         the Department of Community Affairs collects

  7         fees that fund emergency planning and community

  8         right-to-know programs; providing an effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (3) of section 252.85, Florida

14  Statutes, is amended to read:

15         252.85  Fees.--

16         (3)  Any owner or operator of a facility that is

17  required to submit a report or filing under s. 313 of EPCRA

18  shall pay an annual reporting fee not to exceed $150 for those

19  s. 313 EPCRA listed substances in effect on January 1, 2004

20  1998. The department shall establish by rule the date by which

21  the fee is to be paid, as well as a formula or method of

22  determining the applicable fee under this subsection.

23         Section 2.  This act shall take effect July 1, 2005.
