  1                      A bill to be entitled

  2         An act relating to the Florida Hazardous

  3         Materials Emergency Response and Community

  4         Right-to-Know Act; amending s. 252.81, F.S.,

  5         redesignating the act as the "Emergency

  6         Planning Community Right-to-Know Act"; amending

  7         s. 252.85, F.S.; updating a reference to a

  8         federal list of hazardous substances for which

  9         the Department of Community Affairs collects

10         fees that fund emergency planning and community

11         right-to-know programs; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Section 252.81, Florida Statutes, is

17  amended to read:

18         252.81  Short title.--Part II of this chapter,

19  consisting of ss. 252.81-252.91, may be cited as the "Florida

20  Emergency Planning and Community Right-to-Know Act." "Florida

21  Hazardous Materials Emergency Response and Community

22  Right-to-Know Act of 1988."

23         Section 2.  Subsection (3) of section 252.85, Florida

24  Statutes, is amended to read:

25         252.85  Fees.--

26         (3)  Any owner or operator of a facility that is

27  required to submit a report or filing under s. 313 of EPCRA

28  shall pay an annual reporting fee not to exceed $150 for those

29  s. 313 EPCRA listed substances in effect on January 1, 2005

30  1998. The department shall establish by rule the date by which

 1  the fee is to be paid, as well as a formula or method of

 2  determining the applicable fee under this subsection.

 3         Section 3.  This act shall take effect July 1, 2005.

 5          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 6                         Senate Bill 200

 7                                 

 8  The committee substitute changes the name of the act from the
    Florida Hazardous Materials Emergency Response and Community
 9  Right-to-Know Act of 1988, to the Florida Emergency Planning
    and Community Right-to-Know Act.
10  
    The committee substitute also changes the date of a referenced
11  federal list of hazardous substances.
