11 The Committee on Judiciary (Posey) recommended the following
12 substitute for amendment (101070):

14 Senate Amendment (with title amendment)
15 On page 1, lines 21-31, delete those lines
16
17 and insert:
18 (d) The employing agency of a law enforcement officer
19 as defined in s. 943.10 is not liable for injury, death, or
20 property damage effected or caused by a person fleeing from a
21 law enforcement officer in a motor vehicle if:
22 1. At the time the law enforcement officer initiates
23 the pursuit, the officer reasonably believes that the person
24 fleeing has committed a forcible felony violation as defined
25 in s. 776.08; and
26 2. The pursuit is conducted by the officer pursuant to
27 a written high-speed pursuit policy adopted by the employing
28 agency. The policy must contain specific procedures on the
29 proper method to initiate and terminate high-speed pursuit.
30 The law enforcement officer must have received instructional
31 training from the employing agency on the written high-speed
