11  The Committee on Domestic Security (Wilson) recommended the
12  following amendment:
13  
14         Senate Amendment 
15         On page 2, line 4, through
16            page 3, line 5, delete those lines
17  
18  and insert:  frequent basis for purposes of business or
19  pleasure but who has not immigrated to the United States.
20         (2)  A license issued under this section is valid for 2
21  years following the date on which it is issued or, if a
22  nonimmigrant visa is required for entry into the United States
23  by a driver license applicant, then a license issued under
24  this section is valid for the duration of the nonimmigrant
25  visa issued to the applicant by the United States Government,
26  up to a maximum of 6 years. If the nonimmigrant visa driver
27  license applicant is holding a nonimmigrant visa with less
28  than 6 years' validity remaining on the nonimmigrant visa,
29  then a license issued under this section is valid for the
30  duration remaining on the nonimmigrant visa issued to the
31  applicant by the United States Government and may be renewed

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. CS for SB 2040 Barcode 240622 1 thereafter under the same restrictions and conditions as the 2 initial issuance if the applicant, at the time of renewal, 3 satisfies the requirements of this section. 4 (3) When an applicant for a driver license is from a 5 visa-waiver country that has been identified as such by the 6 Department of Homeland Security, the applicant shall, upon 7 meeting all eligibility requirements, be issued a license or 8 an identification card, or both, for a period of up to 6 9 years. Such a license or identification card may be renewed 10 thereafter under the same restrictions and conditions as those 11 applying to the initial issuance if the applicant, at the time 12 of renewal, satisfies the requirements of this section. 13 (4) To receive or renew a driver license under this 14 section, a legal nonimmigrant visitor applicant must submit to 15 the department all of the following: 16 (a) A valid passport from the home country of the 17 applicant. 18 (b) For an applicant entering from a country that is 19 not identified by the United States Office of Citizenship and 20 Immigration Services as a visa-waiver country, a valid 21 nonimmigrant visa issued to the applicant by the United States 22 Government. 23 (c) A valid and current I-94 form issued by the United 24 States Office of Citizenship and Immigration Services to the 25 applicant. 26 (d) A valid driver license from the home country of 27 the applicant. 28 (5) Each such applicant must provide, in addition to 29 the items specified in paragraphs (4)(a)-(d), evidence 30 satisfactory to the department which shows: 31 (a) Proof of ownership of or a leasehold interest in a 2 9:34 AM 04/25/05 s2040c1b-ds33-c2r

Proof that, for a period of at least 6 months 5 during the previous 5 years, the applicant has had: 6 a. An established presence in this state; or 7 b.
