  2         An act relating to trust funds; amending s.

  3         250.175, F.S.; creating the Welfare Transition

  4         Trust Fund within the Department of Military

  5         Affairs; providing for sources of funds and

  6         purposes; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (5) is added to section 250.175,

14  Florida Statutes, to read:

15         250.175  Trust funds; authorization; name; purpose.--

16         (5)  The Welfare Transition Trust Fund is created

17  within the Department of Military Affairs.

18         (a)  Funds to be credited to the trust fund shall

19  consist of funds collected from the Temporary Assistance for

20  Needy Families Block Grant.

21         (b)  Trust fund moneys shall be used exclusively for

22  the purpose of providing services to individuals eligible for

23  Temporary Assistance for Needy Families pursuant to the

24  requirements and limitations of part A of Title IV of the

25  Social Security Act, as amended, or any other applicable

26  federal requirement or limitation.

27         (c)  Notwithstanding the provisions of s. 216.301 and

28  pursuant to s. 216.351, any balance in the trust fund at the

29  end of any fiscal year shall remain in the trust fund at the

30  end of the year and shall be available for carrying out the

31  purposes of the trust fund.

 1         (d)  In accordance with s. 19(f)(2), Art. III of the

 2  State Constitution, the Welfare Transition Trust Fund shall,

 3  unless terminated earlier, be terminated on July 1, 2009.

 4  Before its scheduled termination, the trust fund shall be

 5  reviewed as provided in s. 215.3206(1) and (2).

 6         Section 2.  This act shall take effect July 1, 2005.
