  1                      A bill to be entitled

  2         An act relating to motor vehicle and motorcycle

  3         insurance; creating s. 627.7289, F.S.;

  4         requiring certain insurance policies to provide

  5         coverage for towing and impoundment costs

  6         relating to recovery of stolen vehicles;

  7         prohibiting application of a deductible to

  8         coverage of certain costs; requiring the Office

  9         of Insurance Regulation of the Financial

10         Services Commission to enforce the provisions

11         of the section; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 627.7289, Florida Statutes, is

16  created to read:

17         627.7289  Required comprehensive coverage; deductible

18  not to apply to motor vehicle or motorcycle towing or

19  impoundment costs.--Any insurer issuing insurance policies in

20  this state covering motor vehicles or motorcycles shall

21  include in the comprehensive coverage provisions of such

22  policies coverage for the costs of towing and impoundment in

23  connection with the recovery of stolen motor vehicles or

24  motorcycles covered under such policies. The deductible

25  provisions of any policy of motor vehicle or motorcycle

26  insurance, delivered or issued in this state by an authorized

27  insurer, providing comprehensive coverage or combined

28  additional coverage shall not apply to coverage for the costs

29  of towing and impoundment in connection with the recovery of

30  stolen motor vehicles or motorcycles covered under such

31  policy. The Office of Insurance Regulation of the Financial

 1  Services Commission shall enforce the provisions of this

 2  section.

 3         Section 2.  This act shall take effect July 1, 2005.
