14 On page 9, before line 1,

16 insert:
17 Section 7. Upon the request of the Clerk of the Court
18 Operations Corporation, the Legislative Budget Commission may
19 approve adjustments to one or more of the clerks' maximum
20 annual budgets for court-related duties, to pay the increased
21 costs due to increases in the number of judges authorized by
22 the Legislature in one of the following circumstances:
23 (1) The Clerk of the Court Operations Corporation
24 providing the Legislative Budget Commission with a statement
25 of the impact of the proposed budget changes on state
26 revenues.
27 (2) The Clerk of the Court Operations Corporation
28 provides evidence to the Legislative Budget Commission that
29 the clerk of the court who is the subject of the request is
30 meeting or exceeding the established performance standards for
31 fiscal management, operational efficiency, and effective

1 collection of fines, fees, service charges, and court costs.
2 If a clerk of the court is not meeting or exceeding the
3 performance standards, the Clerk of the Court Operations
4 Corporation shall reduce the requested budget increase by the
5 amount it determines the clerk could save by meeting the
6 performance standards for fiscal management and operational
7 efficiency and the amount of the additional revenue if the
8 clerk met the performance standards for collection of fines,
9 fees, service charges, and court costs.
10 (3) The Clerk of the Court Operations Corporation
11 provides the Legislative Budget Commission with a proposed
12 staffing model, including the cost and number of staff
13 necessary to support each new judge for each clerk who is the
14 subject of the request.
15 (4) The Clerk of the Court Operations Corporation
16 provides the Legislative Budget Commission with an analysis
17 indicating that the total amount of any approved increase in
18 the clerks' maximum annual budgets for the cost of new judges
19 in the county 2005-2006 fiscal year does not exceed
20 $3,622,239.
