11 The Committee on Ways and Means (Crist) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 8, lines 17 - 21, delete those lines
16
17 and insert: (2)(a) The judicial offices created in sections
18 2 and 4 of this act may not be appointed by the Governor but
19 shall be filled by election in 2006 pursuant to chapter 105,
20 Florida Statutes. Candidates for those judicial offices shall
21 qualify as provided in chapter 105, Florida Statutes.
22 (b) The legislature finds that no emergency exists and
23 that public business does not require immediate appointment of
24 the judicial offices created in sections 2 and 4 of this act
25 prior to the effective date of those sections.
26 (c) Notwithstanding the effective dates of sections 2
27 and 4 of this act, the creation of the judicial offices in
28 those sections shall constitute vacancies in office for
29 purposes of qualifying for the 2006 general election.
